How do I file a answer to a civil complaint in Massachusetts?
A credit card company has filed a civil complaint against me. It says I have 20 days to file my answer to it. How do I do this? Is there a special form? I live in the state of Mass, if that has anything to do with it.
Answers:
An answer is a not a form. It has to respond to the claims of the plaintiff. Without knowing the specifics, there is probably a "general denial of all claims" that you should file. But then again, if the complaint is verified, which means each and every allegations is sworn, you need to respond to each and every allegation. Bottom line? If the complaint is for cash money you owe, you need a lawyer to either anser the complaint or negotiate a settlement. Ya see, come the wet **** hour, us lawyers are EVERYBODY'S daddy. (Al Pacino.)
You need to consult a lawyer. Your state may or may not require verified denials, specific denials of each paragraph of the complaint, and a myriad of other technical rules which if not followed may result in your admission of the facts alleged by the credit card company. If you do not respond in the 20 day time period, a default judgment will be taken against you.
go to your county courthouse and to the county recorder, and ask them where you file your answer.
