My Dad has a second family & a US citizen, are we entitled to benefits like his second family if ever?
Answers:
If his marriage to your mother is a legal one, I guess you would be.
What, like handouts? NO
You gave little info. Is your dad divorced from your mother? If so, then only the children are eligible but must reside in the US and must have some type of legal status to receive benefits such as Social Security. If he has a life insurance policy then only the children can receive a portion of his insurance or his estate as well as his second wife and children. Especially if he pays child support. If you are legal, then you can receive Social Security benefits until 18 yrs of age or if you are in college full time you can receive up to age 25, part time your benefits are diminished some. But this only happens if he dies.
If he is alive, the only benefits you are allotted by law are child support which is monitored by your mother until you are 18 yrs of age or if she dies then you are beneficiary. He is also required to carry medical insurance on you if he has medical benefits from his job and your mother (if remarried) and stepfather does not have that ability. If he is not paying child support or paying his "fair share" to take care of his first families children then he can go to jail and be forced to pay child support but that makes your mother and siblings eligible for some types of welfare assistance. But, remember, this is only if you are a legal resident in the US and can show that he is actually your father. The benefits upon his death are international and you will have to have a lawyer to petition the courts in the US to receive your share of inheritance if any.
Depends on what benefits you are speaking of.
