HELP?

Answer:
Immediately get a new attorney based upon recommendations of friends, not advertising. File a disciplinary complaint against your attorney to stop him from doing this to others. Have your new attorney sue him for malpractice and raise the defense of "ineffective assistance of counsel" as an earlier answerer suggested. Based upon what you posted, you have a strong case. Contact your state bar office for the Disciplinary Complaint form. You've been wronged in several different ways.

Get a new lawyer. Better yet, do not put yourself in a position to need a lawyer.
CONTACT the state bar and report him operating unethically.
First I would file the necessary paperwork to the Courts for Ineffective Assistance of Counsel. This is in essence a motion that describes your attorney's ineptness and your right to adequate counsel. If the Court grants the Motion they will have to hear your case again. Then I would file a civil suit against the attorney to get your money back. If the Court rules in your favor on the ineffective assistance of counsel, your civil suit will have merit and this attorney would pay you instead of having his ineptness heard in Court. Then I would file a complaint with the State Bar Association and the American Bar Association against this attorney. So many attorney's take peoples money and do such a shoddy job defending them that more people should do the above.
1. boardline misconduct how were you really harmed?
2. this is totally OK if the other attorney was in his firm
3. ok if same firm
4. depends on how much you are calling him taking up time
5.no idea what you are talking about here
6.one to days before can be normal
7. you are probably annoying him and not worth his time. he can withdraw if the judge allows.

i dont really think he messed up majorly and people that say ineffective assistance of counsel dont know what their talking about. this has to be after you lost the case, and the errors have to be agreauous. and it doesnt seem like you have yet
