Answers:
Actually, there are two specific laws against this, that a prosecutor can argue, those being solicitation of a minor and child endangerment, and this is only if you don't do *anything* that involves a sexual activity. Then you could get bagged for many, many more charges. I've only listen federal, not state laws, however, so the punishment could be even more severe.
No.
You can't arrest somebody for talking, but you can arrest them for crossing state lines without parent's permission.
Heck, I'm 6 years older than my wife. Give them a few years and no one will care anyway. Let them be friends and probably the relationship will fizzle out anyway on its own.
Remove the phone.
If they have sex and it's proven in a court of law the 18 year old can be convicted of statutory rape.
What are the parents doing about this problem? I'm thinking if it were my child I would invite the 18 year old over to meet me and my husband, perhaps over dinner with the girl. Chances are an 18 year old that is talking to a 14 year old isn't someone she'd like if she met him in real life. But the meeting would let the boy know we are on top of things, we're watching.
first the parents tell the 14 y/o to quit. An 18 y/o guy is not appropriate unless maybe its a family friend or relative who considers her a little sister.
The 18 y/o should be politely warned off. There are some charges that could be considered but they are difficult to prove. They relate to soliciting a minor , or endangering the safety of a minor.
Your local police might be able to advise you.
This is really a parenting problem. The 14 y/o should be restricted in terms of phone and internet priviledges.
I am assuming you are the parent. If not, I would share this with them if you are concerned. If they were to get together and it progressed to sexual contact of any sort, he is guilty of statutory rape in every state. I would get on the phone with him the next time they talk ( or call him yourself) and let him know that if and when they do get together, you will pursue prosecution to the full extent of the law. Maybe that will scare him away. You might also try to find out his parents' contact information and talk to them. You can curtail your daughter's ability to talk with him by disconnecting phones she has access to at night and by controlling her computer use. If she has a cell, I would take it away. You are the parent and you are in charge of protecting your child.
