MASS LAW is this grounds for a dismissal.?

my boyfriend has a criminal complaint against him and the dates on the complaint are completely wrong .and the charge was Larceny over $250 by a single scheme, but the complaint was for a return done at his job for $34.99...is this grounds for a dismissal? also the plaintiff has no solid evidence...the day of the alleged crime the officers could not arrest him because lack of evidence..can all this be grounds of dismissal?
