I guess I expected the courts not to stand by the constitution and the people's rights to privacy since they have consistently conclude that people don't own their own property, and that having a bank account in an American bank, under federal regulations can easily be subject to government surveillance.

What do you think about this conclusion about why the ACLU or other groups can't sue - an opinion by a republican judge? I think it's a pretty lame excuse as the ACLU is not representing themselves in a case of damages done to them, but an overall unconstitutional violation of privacy!

The court just decided that the ACLU doesn't have 'standing'. What that means is that the ACLU was not a 'victim', it was suing as a party who hadn't been damaged or hurt. This doesn't mean the suit wasn't merited or that the law wasn't broken, it's just a technicality.
What will probably happen is that there will be another suit, this time by the actual victim, backed by the ACLU.
But you're right. You have to wonder if suits brought by Christian-based or business-based action groups would be seen the same way.
