If you only work 7 hours, are you entitled to the last 10 min break if you wait till the end of the day?
working 5:30 to 1:00. took lunch from 10:45 to 11:15. my boss said I was not entitled to the 10 min, because it was not a 4 hour period.
Answer:
You need to check with the workforce commission in your state.
You're entitled to a break every 4 hours.
I do not believe so.
I believe that is the policy of the paticular employer.
However, check the link below.
BREAKS ARE NOT REQUIRED TO GIVE BY LAW. THE ONLY BREAK BY LAW AN EMPLOYER IS TO GIVE YOU IS YOU LUNCH BREAK THAT HAS TO BE AT LEAST 20 MIN LONG. THE OTHER BREAKS ARE JUST A COURTESY OF YOUR EMPLOYER.
It is never a good idea to use time that could have been used for a break during the day as a way to leave work early. If you want to move around your break time in this way, you should ask your boss for permission first. If you have a boss that holds you to silly things like this when you have obviously put in a full day in all ways, you need a new boss. Don't quit, but shop around for another job and during the interview ask what the office culture is like. Don't specifically ask how closely they hold you to hours, just ask what the culture is like, uptight, laid back, friendly, etc. See if you can talk to people that are already working there in an open manner. If you get the feeling that they aren't being open and relaxed, then chances are the place is uptight and keep looking.
Workers are entitled to a minimum 20-minute rest break in each shift lasting over six hours
30Min's if you are a minor.
