Can a minor sue another minor in the US?
I'm 17, and someone who's under 18 threatened to sue me. He lives in a totally different state from me, and he just got pissed about something on a website. So can he sue me, or should I just make mock him for that?
Answers:
No, he can not sue. His parents have to sue your parents.
You should mock, ridicule, demean, and insult his pathetic understanding of civil law and general lack of intelligence. Oh, and don't forget to question his manhood as well.
I am sure he can try to file suit, if there is a monetary value to what he is suing you for. If you slandered him, he could file, but likely at 17 it wouldn't work too well.
His parents can sue your parents by filing the lawsuit via Guardian ad litem.
For example, if you punched another kid on the playground and broke his jaw and you were both under 18, his parents can sue your parents to recover damages.
A minor cannot sue another minor.
Legally, depending upon the cause of action/claim, a minor can sue another minor.
Practically, however, he probably would have to file the suit in your area/venue, and he would have to make all the appearances in that venue.
I need more info to make a proper determination and give you a more definitive response.
Any person can file a lawsuit. However he cannot do it without a lawyer. Unless the case has some merit the lawyer is going to refuse to take the case. Most will refuse it. Genarally the threat would involve adults. Nobody can sue you in the US for something you have written. The constitution protects you from that. However if you wrote something that actually caused him harm then he could have a case against you but again the lawyer would only take it if it was possible to win the case. If somebody gets hurt because you wrote something , lets say they get fired or the wife dumps him , or he loses money its possible he could get a judgement against you. Because you are a minor it is near certain no court will hear the case . writing is a thought crime and most people arent intrested in that kind of stuff . There is no money in it for the lawyers. So its not likely. But now once your 18 its open season . and... ya never know maybe his uncle is a big shot lawyer with idle time . When you publish anything about other people on the web be aware that they have many ways to retaliate you. So be a grown up . Don't push your luck . Apologise.
yes... Anybody can sue anybody, even out of state. They serve you papers and it will cost you some money just to show up in court. That's pretty good revenge , even if the judge throws out the case against you. Never underestimate bold kids . They are not afraid.
