The meds they gave for my 18 month old wrong meds?

I recieved what i believed was my daughters floride perscription and i opened the bag which had her name on it with address, Then the box which also had her name on it and perscription name . So who would think the bottle i pulled out had a different name and doctor. what if it was to kill her that is just scary makes me wonder what my options might be as far as a lawsuit? Not to say i am just curious?

Since you didn't use it there is no grounds for a lawsuit. You would have had to have accidently (which means you cant do it now that you know it's the wrong meds) given the meds, and your daughter had a bad side effect of it. Since you didn't give it, and if fact caught it before giving it there's nothing to sue for. Bring it back to the drug store and ask for the store manager, not assistant or otherwise, and ask how this could have happened, what they're going to do to prevent it again.


I would contact the Pharmacy who gave you the wrong pills. Forget the lawsuit, somebody else apparently got your babies medicine.
If you did not give it to her and there were no damages you can not sue. You are a very good mother though always check any new prescriptions and refills before you administer the medication. Take it back the pharmacy though and make them aware of the error.
