Has any one be caught drink driving? if so please advise?
First of all it wrong and stupid and I wish i never did not for the fact i got but just for fact that it could have been worse.
I run a red light and the police pulled me over did a breath test and that went red. I was arrested and went to the police station where they did another test on the big machine the reading was 50 which means that i was just over the limit however it's still not enough for them to be sure. I was told that i would have to wait for the doctor to arrive to take blood they locked me up until then the Doc took my blood and i was told that due to the amount of time that i spent in the cell it was more then likely to come back alrite. i was told that i was bailed to come back in September and that I was still allowed to drive.
My question is has anyone else been through this? and if my reading was 50 would my blood test come back as beinf over the limit ?

My husband also fu@*ed up and got arrested for drink driving , for your information 35mg per 100 is the legal limit so you were more than just over the limit, anyway unless the police are sure of a conviction they have to let you go and by the sounds of it by the time the doctor arrived your blood level had dropped below 40mg per 100 as this is what they prosecute on. This time you were lucky don't do it again as next time you might not be.
There is no excuse for driving under the influence. You got less than you deserve.
Your first mistake was even taking the breath test. If you are pulled over don't perform any of the tests, if you are drunk that is. All they do is give the courts evidence against you. Without the tests people usually get off on reckless driving.
Something very similar happened to me but it was about 15 years ago; attitudes in the police force and judiciary may have changed since.
Anyway, my situation unravelled just like yours - after the two breathalizer tests came up marginally over, I was given the option of either providing a sample of the blood or a sample of urine. Interestingly, they told me that providing a blood sample would entail bringing in a doctor, which might take a couple of hours.
Being sober enough by this stage to see the obvious benefits of delaying the next test for 2 hours, I opted for the blood sample.
I was given a sample of the blood taken by the doc and told I would be given the results in a fortnight. These came up negative and I was let off with a caution.
My guess is that you will get similar treatment. You seem to be showing enough genuine contrition and acknowledgement of wrong-doing, so they are likely to be lenient and let you off with a bolloçking. Taking people to court costs a lot of money and they are likely to only want to bother with people who demonstrate real contempt for the law.
