Is Drug testing an invasion of privacy?
I think it is. Even though drugs can affect a person's job performance: what some1 does on their own time should be THEIR business. PLUS cocaine is far more lethal & it sticks around far less time in the body than THC does. What a crock of poop! Then alcohol causes more absenteeism in a job than anything but they don't care about that. I'd rather have a pothead working for me than a hopeless alkie!

It is an invasion of privacy and a back door method to get their hands on DNA legally without asking you personally for your permission, it's ironic that weed smokers made the best workers but drunks are a hazard to everyone in the work place.
If you don't want to give up your privacy, then don't. Get another job that does not have drug testing requirements. I personally would not want to work with anyone who use illegal drugs. If they can't obey those laws, how far can you trust them period?
Are you a dope head? If you own the company you can choose to have potheads work for you. Most employers do not want dope smokers in their place of business.
There are jobs that do not require drug test. I think most of them center around poles and corners.

An Employer is responsible under the law to provide a safe and healthy workplace! In the world today, the only way he can do it is to screen his employees! If you are a law abiding citizen, you have nothing to worry about! If you break the law, and something to hide, I don't want to work you with anyway! And the boss can't afford to have you around either!
It is not an invasion of privacy. Given the choice, I would rather not have either one working for me. Fact is, there is not only the job impairment to consider, but some will steal to finance their habit, I have seen it.

I believe that drug testing is an invasion of privacy. But if you have a situation that warrants it , your privacy can and will be invaded. The constitution does not guarantee us the right from invasion of privacy.

I have more than once successfully defended people who tested positive on drugs. No I'm not a lawyer. I hate drugs but I hate companies who refuse to follow the law even more. They often use these drug test to falsely fire people. If you work heavy machinery, they have a right to know because you might hurt someone. I had to work with two pothead once and it was a nightmare because of their behavior problem.
Except in situations of public safety, like bus drivers, pilots, etc., I don't think drug testing should be a routine event. I think it should follow the rules of probable cause. If your eyes are dilated, or your behavior is erratic, then your employer should have the right to demand a drug test.
Also, I think drug testing should go both ways. If my employer demands that I pee in a cup and get tested, he/she should be tested too, and I, as the person who has to follow his/her orders should get to see the test results. The people in charge of a company have a lot more potential for causing harm through their drug impaired decisions than the ordinary workers do.
By the way, I don't use any illegal drugs, and the only legal ones I take are those prescribed by a physician and used in accordance with his instructions. That's why I resent drug tests. I feel I should be deemed trustworthy until I prove myself to be otherwise.
If drug testing is done either randomly (truly random, not just random they see you looking funny random) or based on a specific situation (i.e. in any incident where time or money is lost, it is mandatory) then it is not an invasion of privacy. They don't get to see what is in your body that is not drugs -- they are only testing for an illegal substance.
