Michigan Child Support & SSD Question..HELP!?
I am the Plantiff in this case. The defendant is asking that child support be suspended pending SSD application. Defendant is also on welfare. Typically the defendant makes one payment each year. Current order is set to pay <$70/month (very low). $3000+ owed in arrears. How do I stop this suspension from taking place? I believe that despite his financial troubles, the child still costs money to raise. I can't just put the child's life on hold when I can't afford it, I have to make due; so why should the defendant be allowed to? I have no confidence in the FOC, as they have always granted the defendant's requests, despite defendants history (I think it has something to do with defendants parents being in politics). I need to know ANY steps I can take to stop this. We have a court hearing in 2 weeks!

I'm not sure if there are any steps that you can take to stop it. If he is on welfare,more than likely they will allow the suspension. Welfare pays such a little amount,I don't know how he could be expected to pay it. If you are living without it now,they will probably figure you can do without for a while longer. Not fair,I know,but if he has no income he can't pay.
That being said,if he is applying for disability through SS,you will be getting a check for your child every month once he is approved. Your child's check will be half of what his check is monthly. You will also get back pay for your child for the time he is waiting to get approved. Just make sure that he has your child listed as a dependent on his case.
I know how hard it is to raise a child alone financially,I went many years without child support myself. But know that once he is approved,your child will be receiving much more than $70.00 a month and it will be a guaranteed monthly check.
