Im 17 and my girlfriend is 18. she bought me a cell phone. my dad broke it, it still works, my mom took it.?

i live in north carolina. what can i do about him breaking it and my mother taking it away? the phone is my girl friends and my father broke it. what can be done?

If it is your girlfriend's cell phone, you can't do anything about it. Your girlfriend can ask for it back, if she wants it.

Since you are 17, you cannot legally enter into a legal contract; therefore, you cannot own a cell phone. You have no legal recourse here. Your girlfriend, on the other hand, may have a legal claim on the cell phone since she is the one who bought it and is the one responsible for the service contract.

Does she have insurance on the phone? If so, she would have to make a claim and pay the extra money to get a new one. Don't mind me saying, but you seem more mature than your own father; as well as your mother. If anything, your girlfriend will have to file charges since it is technically her phone. I am sorry that it had to happen
There's nothing that you can do, because you did not buy it. Your gf has to be the one to do something, and chances are that no one will take it very seriously. They will likely see it as a family matter, and taking your age into consideration, tell you to work it out with your family. I would suggest waiting until you are 18 and buying your own cell. This way, at least, you can possibly be seen as an adult and taken a little more seriously, rather than a kid who's angry at his parents. Remember...police are usually parents too, so they will be more likely to empathize with your parents; this may not seem right, but it's just the way that things are.
