Why is it illegal to ask on a job application if you have had workmens comp cases...?

Why is it illegal to ask on a job application if you have had workmens comp cases, but then its ok for them to get a background check and see the workmens comp cases??
This is for OHIO.

My Guess is because it would be considered a medical case and you don't need to inform companies about your medical backround.


Are you sure that workman's comp cases show up on standard criminal backgroung checks? If it is, then it sounds like a loophole which should be closed.
The only way that would be on a background check would be if you were involved in a fraudulent workers comp case.
I think you got your wires crossed...if your applying for a truck-driving job, that questions on there...
