Is there a statute of limitations for filing a suit in small claims court in North Carolina? Car accident.?
I was the victim of a rear end collision, and haven't been able to afford filing the papers...yet.
I'm thinking I'm through, as far as any chance of pursuing the driver who hit me. It happened over a year ago, and because of a false statement given, their insurance denied me. I lost my car through no fault of my own, and I now have the money to file the case, but don't know if I can. I think it's too late. I live in New Hanover County. Wilmington N.C.

If you were rear ended, you should sign a contingent fee agreement with a personal injury attorney. He will handle it for you and he gets paid only if you win.
There are a lot of attorneys that will give free advise. So check the yellow pages and ask around, they won't take your case unless they can get something also. At least it was not me that rear ended ya.
Yes there is a statute of limitations. I do not know what it is, but ANY attorney's office can tell you that. Most of them will consult with you for FREE. Go see one. (Usually it is 2 years)
