Law regarding songs in mp3 format?
in US law, are the following circumstances criminalized?
a) downloading off of a website/p2p app (itunes not counted)
b) hosting songs on a site/p2p
c) travelling to the US with a burned cd, with songs from a site/p2p, which you yourself burned for personal and not commercial use.
d)travelling to the US with a burned cd, with songs copied from legitimate purchased records of artists.
e) travelling to the US with songs in your ipod downloaded (itunes not counted) from a site/p2p
f) travelling to the US with songs in your ipod copied from legit purchased records of artists.
on what charges are they criminalized? penalties? can you be deported?
Answers:
a) If the p2p site does not have a license from the copyright holder to distribute the song, then it is illegal.
b) If you illegally downloaded the song (see a), the cd you burned is illegal.
I think all the others are illegal based on a).
But, if you are bringing illegally downloaded songs into the US on your ipod, I don't know how anyone could tell if they were obtained legally or illegally.
