If your x has threatened to kill you over the phone do you have to go to his st for custody in fear of life?

Probably. However, one phone call won't get you custody of the kids. Sorry. Go see an attorney and get a restraining order. Although it is "just a piece of paper" and won't actually stop him from doing anything, it is the beginning of a VERY helpful paper trail.
