Is there anyway a criminal could commit a crime and get away with it by beating a DNA test?

It's not like a lie detector or drug test where there are ways to cheat. You cannot change your DNA.

Yes. DNA can be used to establish who provided a biological sample. It does not establish when that sample was provided or the circumstances. For example, in a rape case, the DNA sample can show the source of the semen but that does not establish if the sex was consentual or not. Furthermore, some DNA tests are more accurate than others. With degraded samples, for instance, the test can only narrow the donor down into one of several thousand people. In a major city, there could be many who are not excluded by such a test.
Finally, not everyone's DNA is in a database. if the cops have a DNA sample from an unknown subject, that does not mean that they can figure out who did the crime.
