Ethics Question HELP Quick?
can u go to jail (felony) if you were rerouting clients to your individual business if our current business couldnt (meaning they had no more room to service them) service the clients if they were already rerouting clients to other businesses??
please explain... thanks

Huh? What's meant by rerouting and whose clients? Is this an employment contract question or something for the Federal Trade Commish?
if a company you work for cannot handle the load and subcontracts it out, that is legitimate. if you are tell their customers that you will come as an individual after work hours and pocket the money, then they would have grounds to dismiss you unless you made prior arrangements with them.
also, what kind of application did you sign and what were the stipulations of your employment? that would be a consideration also.
Definitely not a felony and no jail time. However, in civil matters, the law tends to look unfavorably on such self-dealing, calling the activity a violation of an employees duty of loyalty to the employer. However, the fact that the employer was turning clients away due to overcapacity is a very good defense. If the employer were to contest the fact that they were turning away business, you could have a civil court case where the employer seeks to recover the profit they would have received from the clients routed to your personal firm.
