If someone got fired for stealing?

and the employer said no charges will be brought, will they be able to press charges if new things are found out? if they figure out that the incident happened before, will they be able to sue? or is it out of their hands?

An employer will have a certain length of time to decide to file charges against the employee. The length of time will vary, depending on the state you live in. Usually this time period, also called the Statue of Limitations, will be anywhere from 2-3 years for a non-felony, and up to 5 years for a felony. The employer has that length of time to call the police. Yes, they can sue, but usually a stealing conviction will require restitution as part of the sentence.


I don't think it would be a lawsuit, but they could probably be able to press charges.
well this depends on exactly what the employer said. if the employer stated that no charges would be brought for the incidents that caused the firing, then new thefts that occurred could be prosecuted. but if they said no charges would be brought against any thefts, then they can't sue. however, they might be able to say that new evidence changes the situation and a retrial is needed.
It is not a question of suing the suspected thief. The employer won't be suing the former employee for damages. Rather, the employer may turn the matter over to the local police/prosecutor for criminal prosecution. The prosecutor makes the final call whether to bring charges against the suspect, but if the theft is a repeat happening, the facts would weigh in favor of charging the suspect.
