My Uncle died yesterday, who informs the state and county after the death of a relative?
We have informed social security and ordered death certificates but since he doesn't have a will, the state should take care of administering his estate. Do we have to do anything?
Answers:
It doesn't just happen automatically. Someone has to file for probate in the county where he died. You would do this at the county courthouse.
The state has requirements on how property is to be disposed of if someone dies intestate (without a will), and filing probate allows someone to act as the personal representative of the estate.
Since your family is not familiar with the law dealing with probate, hire a lawyer to do this for you. Unless you follow the law exactly, it is possible that there could be mistakes made and extra costs paid. The cost of the lawyer and the probate will be paid out of the estate. Probate will also allow for the paying of your uncle's burial and funeral expenses out of the funds of the estate.
