Crazy rental situation at her house?
We currently rent a house in Florida and have been here since March. Our lease we signed is with one property manager who apparantly got fired and someone else took over without our knowledge until about a month ago. We were still paying rent to the old manager and have proof. We recieved a 3 day eviction notice from the new managers lawyer today stating that we owe them 5900.00 by august 22nd or we have to leave. We have given them all the proof we paid but they are not accepting it. They never gave us a letter as required by law stating they were taking over or where our security deposit is, by the way. What should we do. We have the option of moving into another house next saturday, but will they sue us after we leave. How can they when they have never even given use proper notification that they took over and we have already paid what we owe up to date. If we move, technically we are not breaking the lease b/c it was with someone else who is not invloved anymore anyway. Any advice

Well first of all I would consult a lawyer b4 you do anything else. second of all...i think you need to take your original property manager to small claims court. you can't really sue the current managers for anything but you can most definately sue the original manager to get back the money you paid him to which he was not entitled. then after you have that you can turn it over to the current managers. I would go ahead and move if i were you b/c it is apparent that you are dealing with shady managers and it's prolly not wise to stay there knowing that. If they do try to sue you for the back rent then you can give them the money the original manager has to repay you if you do take him to small claims court. after calling a lawyer, i would first move, then file a claim against the original manager and then once that is done you can take care of the debt you owe to the current managers IF you even have to pay them anything (which you may not end up having to do if they did not give you proper notification of takin gover or anything like that) I'm not a lawyer, just my opinion. hope this helps

They have no case. Have your lawyer greet the Sheriff.
sue your old land lord so he can give you the money that he took
and get a lawyer.
I also suggest that you and your attorney sue the bank from where your checks were drawn. It could be argued that they should have known that Bad Property Manager was fraudulently depositing your funds, for an extended period, too.
