No, according to them you do not have a job. Since you are working off the books employee rights do not extend to you as your job does not exist.
You want more money, get a legitimate job and report your previous employer to the IRS.
If you agreed to that and don't like it anymore, take it up with your employer. Places that do things under the table often do this for their employees benefit as well as their own. If you aren't happy with the arrangement (because you aren't illegal or cheating on unemployment or taxes), ask your boss for something more normal before you rat him to the authorities. It usually doesn't cost him much to do this--when he pays you under the table, he pays income tax on it instead of you!

if the employee is anything other than a direct ,close family member the government will do all it can to screw the employer. AND the employee who entered into the relationship in free will.
Nope but the employer can be fined for paying under the table. I know of a bar that has been under 5 different owners becuase every one of them paid under the table and got caught except the last one. They finally learned their lesson.
If they are being paid under the table, the employer can say that, that person doen't work for them and it would be tough to prove and they wouldn't work for them any more.
As long as this is the agreement between the two of you - then nothing will ever be reported to Wage & Labor.
