I believe it isn't a legal marriage if the SS number was fake, but he'll probably either get deported or go to jail. And if she knew he was an illegal immigrant, she might also. Something along the lines of aiding and abetting a criminal.
your sister is party to a crime she should call the ins, and turn him in so he gets deported, then she can maybe get a divorce on the grounds that he abandoned her.

You need an attorney, because I bet there is a fine legal line between using a fake number and entering into a marriage contract with a fake name or other falsified information. I'm sure it also varies by jurisdiction.
Yes, the marriage is valid. I used to work for immigration, he is still considered illegal. Your daughter would have to file alot of paperwork and pay alot of money to immigration to make him a legal permanant resident and he would have to go back to his country for at least 8 months and then enter the country legally. Depending on how long they have been married, she should try and get the marriage annuled. If unable to do so then just file the divorce papers. Good luck to your daughter.
The marriage is probably legal, as I don't think marriage is dependent on the SSN. As to those who think that he automatically became legal upon the marriage, that is not so. INS needs to hold a hearing and examine the marriage before they grant status to the spouse. Was this done yet? How long ago did the marriage happen? His status may certainly be in jeopardy if she decides to get tough. She can probably use that as leverage to get him to agree to the divorce if he gives her a hard time.
Depends on which state it's in. In some states, the simple fact that he lied to her is enough to nullify the marriage but you might want to talk to the local government where you live.

Thats the rub right there. Marriage is a legal contract. If he falsified information to her to enter into the contract then the contract is null and void. If she knew... then its a perfectly legal marriage and depending where you live he may be entitled to half of her belongings just for marrying her and regardless of her reason for the divorce
