This one is for the lawyers??
how legal is it to fire someone from allegedly selling drugs on work property with only word of mouth and no evidence...this was the situation...there were two employees one was in his car and the other came over to it opened the driver side door to look in it and then some other employee supposedly saw them making a drug deal and then later on in the day got fired for it! Which in case no drugs were ever dispersed....no police were involved and when the employee was asked about it he said no and you can even search my car right now if you wanted..nothing was and he was terminated...HOW LEGAL IS THIS???

Um. Well. First off--I'm not a lawyer. But I know that for SURE if you're selling illegal drugs, it's illegal. Period. There's absolutely no way it would ever be legal to do, lol. At least, not by federal government.
Even if the state government says otherwise--like how it's legal to sell and obtain medicinal marijuana in the state of California. If the federal government intervenes, these people can go to jail. Period. Because the federal government supercedes the state government.
As for termination of employment--if an employer deems a person unfit to work for them, they have the right to fire. For any reason, really. Especially if they feel that person is involved in drugs or drug trafficking.
An employer can fire you if you're late, take long lunchbreaks, steal office supplies, or lie to their face...
of course they would fire you if they saw you fraternizing in drug activitiy, regardless if you had them on your person.
It's not illegal at all. They had every right.
Sorry... but it's true! ^___^
Even if you had a contract--being involved in illegal activity breaches that contract. So regardless... >__>;;
Even if said transaction never occured... if an employer is adament that it did, they have the right to protect themselves and their business from such things. So if they really think that what they saw was a drug deal, they can terminate employment for the protection of themselves and their business. *shrugs*
I'm kind of rambling... but basically... they didn't do anything illegal. Although if you want to try, you could file for worker's compensation... however, they may or may not believe...
well, anyway. Good luck to that person.
You can get fired for almost anything. However, if you seek a new job and your previous employer says you were fired for dealing drugs...that would be a different story. You could sue them for defamation.
If you're in a right to work state, there does not need to be a reason for them to fire you.
If you don't have an employment contract (either on your own or through a union), they can fire you for any reason or no reason.
