How are these types of sentencing procedures diffrent.?
I need to know what indeterminate, determinate, presumptive, and mandatory sentencing are. I have been searching the internet for hours. I can find information about all of them, however i do not understand what i am reading. If you could explain these types of sentencing in stupid person language it would be great.
Answers:
indeterminate: does not state a specific period of time or release date, but just a range of time, such as "five-to-ten years."
determinate:A sentence to confinement for a fixed or minimum period that is specified by statute.(i.e. 3 Strikes Law)
presumptive: specifies an appropriate or "normal" sentence for each offense to be used as a baseline for a judge when meting out a punishment. The STATUTORY presumptive sentence is considered along with other relevant factors (aggravating or mitigating circumstances) in determining the actual sentence.
mandatory:A mandatory sentence is a court decision setting where judicial discretion is limited by law. (the sentencing for that crime is already determined by statute and cannot be evaluated by the judge, almost like determinate)
