Do you have to be present in court when you file chapter 7 in california?

A friend of mine is in debt but will also be serving time for 2 yrs. Is he still able to file?

A Chapter 7 filing requires a Section 341 meeting with the creditors under supervision of the appointed bankruptcy trustee where the person filing for bankruptcy has to appear. Unless the Trustee and/or creditors are willing to conduct the Section 341 meeting from a prison visiting area (which is highly unlikely), either one has to wait 2 years or contact the US Trustee as to how to proceed - maybe notarized affidavits from the person in prison may be enough - who knows.


Yes, he should be able to have an attorney do it.
