What can I do?

I bought a car from Ugly Duckling Corp. in 2001. They picked this lemon up in March 2002. After trying to collect a debt for this lemon, they sold the account to another party. In November of 2006, after I refused to settle up on this case, The second company file derrogitories against me. Im guessing they want to get a quick judgement against me. I answered them. We have not heard anything since, and the courts have said nothing has been done. What can I do to get this matter dismissed against me, other than paying 9000.00 that I feel I dont owe? I got sick last year and had a leg amputated, so I cant work, and hire an attorney. Please help, any advise(not negative) would be appreciated.

Try contacting legal aid or find an attorney that will go pro bono. I don't know if all states have it, but I know at least in my state (MN), there is something called the lemon law to preven this sort of thing.


Consult the hospital where you had the amputation done...they probably have a "Patient Services" department (or something similar) that helps patients adjust to their new life after this type of surgery. They may be able to provide a referral for legal services.

Also, try Googling "disability advocates" and/or "disability services" ...terms like that to see what you can come up with. And, there are a number of good lawyers that do pro bono work...so I'd also search the web for that.

Lemon Laws are typically very specific...you have to meet certain guidelines...and are entitled to specific recourse if the car is determined to be a "lemon". Even if your car was technically a lemon...if you didn't document properly...or follow the correct steps...you may still be responsible for some portion of the arrearage. Just choosing not to pay the loan isn't an option.

I really hope you have all the documentation and repair paperwork somewhere...it's been a pretty long time since this started!
