Can my boss take my cell phone?
after I got off work tonight one of my co-workers called and told me our boss instated a new rule after I left. When you walk through the door all cell phones are to be given to the manager and locked in their office. Is this legal? if not can I get a copy of the law some were to prove it to her?

Sure. Your boss is well with in his rights to ban cellphones from the building. You could also leave it at home or in your car.

Apparently this is a big problem in the work place. I recommend you leave your phone in your car or at home. It's legal.
If you don't have a cell phone with you she/he can't harass you about it... Just leave it in your car and tell them "look its my property and its in my car, I will not use it when I am on the clock and suppose to be working"
I know where I work if you are fiddling with it you get 1 warning if you still do it you get fired!
as the boss, he can make all the rules he wants...whether they make sense or not. I think that ''someone'' isn't getting the assigned job done because they're on the phone a lot.
you can either:
leave your phone in your car.
try to sneak it in anyway.
or ask him to explain why your personal property is being restricted.
I don't know about legal but I do think it's a bit petty, childish, and going off the deep end. I suggest you have a talk with the boss and try to understand why she's suddenly implementing this new policy. I suspect it has something to do with people using their phones too much. Regardless, she's being an idiot.
If it were me, I'd either refuse to hand over my cell (it is my personal property after all) or leave it in the car. It's none of her business what I do with my personal property so long as I store it properly.
I dont think it is legal, but he can implemented thru company rules, and one of the reasons being is that too many people are goofing off and texting people when they should be working. dont let your boss know about your cell phone and lock it in the car before u go to work and u will be fine...
just leave your phone at home or in your car. if you leave it in your car, you can check it and make/return calls during your breaks or lunch break. if someone really needs to get a hold of you, they can call you at work.
I don't think she can actually confiscate your personal property but you should look into this. We have a problem with cell phone usage where I work so we now have a policy the makes the use of cell phones during working hours a big no no. You can go to the attorney generals office and see about the laws concerning this subject. I would look under labor laws.
Do you drive?
Can you lock your cell phone in trunk of your car with it switched off, then when you leave work, open trunk of car and turn it back on?
It seems to me to be reasonable if some company thinks many employees are using personal cell phones for personal phone calls on company time, to confiscate these distractions.
Many companies have a rule. NO personal phone calls to or from the work place, unless it is an emergency. So you give out the phone # of work, tell people not to call unless it is an emergency, and to tell the receptionist what the nature of the emergency is.
If you have a boss who does not believe you do not have a cell phone, then this is easily fixed.
Offer to let yourself be searched in privacy of bathroom, with a witness present from the Personnel Dept or the Human Resources Dept. If you find it, you can take it & I will pay you $ 10.00 for your trouble. If you cannot find it in the search, you pay me $ 250.00 for my trouble.
I would not work at a place where they question my integrity. In fact that is the reason I left one place after having worked there for over 16 years. There was a manager who accused me of being dishonest. I started job hunting immediately, and gave notice a few weeks later. If anyone believed him, I figured my job security was gone.
What joy it was to me that they had to hire three people to replace me. I visited the place a year later. They had two of those people still working there, and had had to downsize the work load that I used to do, because those two could not haneld it.
Well, the building is private property and he/she who manages it can control what you bring in there and what you don't.
yeah i think he can you know he can also send you to the principles office and give you a detention....hell no he is violating your rights and stealing i would contact the authorities
Is your Cell Phone Official and provided by the Company.In that case,it would be ok for your boss to implement such a rule.On the other hand,If your CellPhone and your Friends' CellPhones are personal,I see it as totally unethical to do so .
who pays for the phone? is it a company phone or a personal phone? what kind of job.

if it's a retail job it's probably to prevent you/friends/colleagues from talking on phone/having questionble ringtones on the job. . .
I'd politely ask the boss about some "whys." If the phone has nothing to do with your job. Lock it in your car or at home.
Why would you want to work at a place that does that crap anyway? It sounds ridiculous. It may not seem like it should be legal, but those types always get their way... I recommend quitting and getting a better job.
Everybody thinks their job owes them something.you agreed to do what the boss wanted when you got hired.granted he changed it now, but that's in any business. One can assume this is a 7 dollar an hour job...and it's a bunch of kids with phones...If you're nitpicking over them and a phone.you really don't want to be there, you just want to start something. Feels like the college "I can save the world"..This is all just my opinion.
