That's why people try and dodge process servers who hand out subpoenas. If you never get the written notice, you've not been put "on notice" that you're required in court.
alok...you are sort of wrong about dodging service...if they can prove that they have tried to serve you multiple times and you actively dodged them, it is no longer an excuse
You bet your boots you do. If you fail to respond to a subpoena, you can be fined heavily, and the court can also issue a capias for your arrest.

In fact, the word subpoena in Latin means "under (sub) penalty (poena)" That is, you are required to appear before the court, "under penalty" of law.
