Who do I contact about a doctor who refuses treatment?

I have a pain management doctor who is refusing treatment because of a dental office scam that used my name. Two ladies in a dental office were jailed for writing false prescriptions at an old dentists office of mine. Now this current doctor refuses me treatment because my name was involved in some of the false prescriptions. The issue here is that the women who broke the law were arrested but somehow my name still shows on a list. what do I do? I have never been contacted by police, nor should I, and I have never recieved a prescription unlawfully. But I am paying the price be cause my name was falsly used, what do I do?

A doctor has a legal as well as a moral obligation to treat you in an emergency situation: if you were bleeding after a car crash, for example. In addition, once a doctor undertakes to treat a person, they must give treatment in good faith and to the best of their professional ability (a doctor cannot decide in the middle of a surgery that they no longer wish to treat you).

However, in your case, it is completely within the doctor's discretion as to whether they want you as a customer. They are a doctor who has opened a medical business, just like any other business: you can decide not to buy their services, and they can decide not to sell them to you. In your case, the doctor obviously does not want to sell you medical service, because of a scam. That is their right.

Now, what do you do? First, find out exactly what kind of "list" your name is appearing on, and find the name of the company or entity that operates the list, find out exactly why they placed your name on the "list" and see if it cannot be removed. If this fails, then find another doctor. If they too claim that your name appears on a watch list of some kind, you must explain the situation to them. Get the court documents from the original criminal case (not the police report -- this isn't a car accident), showing the nature of your (non) involvement.


Find another doctor.

You can contact the old doctor's office or the police to try to get your name removed from the scam police report, but the doctor can refuse to treat you if there's a reasonable belief that you might be scamming him for drugs, too.
You need to go to the source - the office of the dentist. If there is fault it lays there. The doctor who refuses to write an Rx for you is, in my view, within his rights.
you shouldn't try to treat doctors, thats just plain stupid
if this is the only reason that he wont help you, go to the state board of medical examiners and ask for help, they will better direct you than anyone on here

Sorry to hear this. What you need to do is contact someone involved in prosecuting the dental office. If this went to trial, the DA's office is likely involved. Give them a call and explain your situation. Ask how your name can be "cleared."

Your doctor is going the right thing. While you can find a doctor that ignores information like this, this is also a doctor that might be sloppy about things you care about.

Hire a attroney to have your name removed and also seek any legal redress in civilcourt . T here is not much you can do about the doctor but your name should not be involved . You should have it removed from any data base . Basically you are being punished for thier crime . You can write yourstate medical board about the incident it is possibly not providing adequet care .But you need another MD to verfy this . You also have to find out how your name comes up at all .
