Should i sue or not?
ok so i bought this cheap bike from walmart that was on sale for like... 70 dollars? i had it for like a month and i rode it maybe every other day. one day im justbiking down the raod and my front wheel fall right off the bike i flip over the handle bars and scrape my face, my back, and my elbow and the side walk. i had abbrasions on my face back and elbow. my nose was fractured. i was really bloodied up and i had to get x-rays and CT scans in the ER. should my famiyl sue? and if i do who would i be sueing? walmart since they put the bike together? or the people who manufacture the bike?
Answers:
Well if you had it for a month and it was perfectly fine then I wouldnt sue. Besides you would have to prove that the manufacturers messed up. That would be really hard to do since this event took place a month after you bought it. It was probably just a freak accident.
Moral of the story: Dont Buy A Cheap Product:You get what you paid for.
I don't know if you should, but if you do, I think it's better to sue the manufacturer.
Wal-Mart has nothing to do with how the bike was put together.
Lets see you already cost us or your insurance company a small fortune with the ER now you want to drive up the cost of ever bike at walmart another couple of bucks...what a great guy...lawyers were made for people just like you.
check with the store first to see what they say first pretty much fishing to see what they say write down names in your head later on, on paper so to not forget what was said and by whom. you kinda get what you paid for if they said sold as is on sale etc.. but you might be able to pull something off see if you can find a lawyer site with a forum and ask there you can get a better response with more detail as how you got the bike etc...
hell yeah i bought the same bike it sucks i want in get enough people together and I'll get started on the paper work these bikes are very dangerous they wont even give me my money back
and its not how it was put together they break on day one !! total rip off just like wall mart if you have a lawyer I'll testify and bring in my bike
You purchased a cheap bike and it didn't work perfectly, what do you expect? If the bike has a guarantee then pursue it that way, but people need to take some responsibility.
If you or your parents had insurance and all your bills from the ACCIDENT were paid, then why sue----no one was there to see the tire just fall off. whomever you sue COULD say you were driving reckless or someone in your home losened the tire on the frame... after all ANYTHING could have happened to that bike in a MONTH. had the tire fallen off the first couple of times you rode it I'd say YES you had a GOOD STRONG CASE, but after an entire MONTH? NO WAY.and then you'd end up in court and lose and have to pay COURT FEES for both you AND either the manufacturer or WalMart (whomever you sued) and trust me Walmart has MUCH better lawyers then YOU could afford!! So I'd say---don't bother suing you could lose a lot more then a little blood .
I didnt read any other guys posts, but what u have to do, is always check the bolts before u go somewhere on ur bike, all the screws, especially on the wheels.
-----
Bikes are not 4ever, they need some fixing...
----
Dont sue... read the book which came with the bike... It says, before going out check the screws...
70$ bike... what did u want a COMANCHE?
Next time make sure, that all screws and bolts sare tight
You can sue both; name Walmart AND the manufacturer in a law suit. It will be unlikely for you to win.
Wal-mart doesn't put bikes together, they just sell them. Sue the manufacturer if you have out-of-pocket expenses, or have your insurance company do it.
Are you from USA ? If so, why not ? IT IS YOUR NATIONAL SPORT ! I am in no way making fun of your accident, but in a country where they state on Superman´s toys : Please note: You cannot fly with this product. (yes, really), in fear of being sued by a desperate women who lost his dumb kid, you got all the odds on your side ! Was your bike manufactured in USA ? You are in luck ! China ? Not sure... consult, and make a percentage deal since most likely, it might result that Wall Mart was not responsible. How much should you sue for ?
hmmm. 500 Millions ! Well, if the court accept to hear the case of a judge on pair of pants for 54 Millions, with no personal injury, you can ask for the moon ! The company will probably try to settle, since nobody knows what these judges are smoking in the back. If their offer cover something more then your medical bill, think about it.
Please be advice : This is in no way from a professional. Please don´t sue me ! Haha USA, Soooo funny ! :)
Good luck !
k dude. i dont think anything that comes from wallmart has quality. u should know that. a bike for 70$? wat do u expect? u think it will last 5 years? i had a bike worth 300 and it lasted for liek 3 years. imagine a 70 $ one. take this as a lesson. if u wanna buy something go to the proper place,
You rode the bike for a month, so it wasn't "completely new." If it had happened the day you got it home, that's another story. You wouldn't stand a chance.
