Are you allowed to name your children trade marked names?

Like if you really love spam and you want to name your daughter Spam, will you get sued?

Answers:
Legally, yes you could.

Being a person is not considered a commercial activity, and inherently being a person is not considered to reduce the value of any trademark.

That latter analysis might work out differently if a person (as an adult) changed their name to be the trademark, because then the person's character could be evaluated to see if it taints the value of the mark. But that's an obscure area of trademark law.


I don't think they would sue you. Maybe they would even pay you. Its good advertisment.
