Is it legal to drive intoxicated on your own land?
Like your own driveway as long as your not on the road and your yard and fields etc...
Also, even if it's not how would they tell if you were drunk or not since they can't come on your land without a warrant.
Answers:
There are many cases finding that someone was operating a vehicle while intoxicated when they were just sitting in their driveway with the key in the ignition. The issue is intent to operate. If there is reason to believe a person intends to operate a vehicle while under the influence, a cop may investigate. There is usually no jurisdictional hook to being prosecuted, meaning, no requirement that the road be the jurisdiction of the officer (i.e. a public road). Therefore, you can get cited for DUI on private property, they just need a reason to know it is occurring in the first place (which would obviate the need for a warrant) or a warrant. Think about it logically, a parking lot is private property and someone can get prosecuted there (they are quasi-public, but that has nothing to do with the charge). It is not true that the police can't come on your land without a warrant. They may investigate under certain circumstances, especially if they have reasonable suspicion that a crime is in progress (DUI would qualify).
No it's not.
Even if it's your own land,if you get caught you will still be charged with a DUI.
If you are in an enclosed area, it is ok, but if you are anywhere near the public roads, you will be nailed.
Most states it's illegal to operate a motor vehicle while intoxicated. Period.
Of course they can pursue a drunk driver onto your property without a warrant.
Just watch out for those damned trees. They may hit you head on, and they can back into you sometimes.
How would they even know about it? Unless cops patrol your farm often it seems they would never even find out. If I am correct, you don't even need a drivers license if you are on your own land. Your truck, your land, it is all your property and you are doing no one else harm. Even if they did arrest you, I don't think it would hold up in court.
