Is it illegal to Tow a parked car while someone is still inside sleeping? No warning given.?
A friend of mine fell asleep while doubled parked, he woke up to his car hitched and being pulled up by the tow truck. He's not to bright and ends up paying off the tow truck guy to leave his vehical. Now wasn't the tow truck guy at fault and actually should be the one paying my friend off not to say anything?

No, I don't think so. The towing company was called by the police, so they have to do their job. The police should have checked to see if anyone was in the car, but I don't think there is any law requiring them to do so in most states. The car was still parked illegally.

He had his freedom taken while in route - unless he wanted to jump from a moving car - therefore it could also be deemed as a FALSE ARREST.

He was physically moved without his consent or permission ... and his property held hostage until he paid those who kidnapped him to release his property.
Certainly one could use a defense against kidnapping ... oh, he was double parked - we had to physically move his person without permission and charge him for our service ...
