Is this legal? Can you be sued to pay your own wages back?
Husband was just sued because his paychecks from13 years ago had bounced and his employer at the time filed bankruptcy and now my husband is being sued for the amount of the checks. Can someone help me?
Answers:
If the checks bounce, your bank has the right to reclaim any money they gave when they took the checks. There is a limit on how long the bank on which the checks were drawn. There is also a limit on how long your bank can sue to collect. 13 years may be past the statute of limitations for both even back to back. The exact time allowed varies by state.
Checks expire in 6 months. 13 years old checks are expected to bounce as "stale" regardless of the condition of the company.
It is way beyond reasonable to keep a check for 13 years without cashing it, then deposit it expecting it to be worth anything. If it ever goes to trial, the judge will almost likely laugh the case out of his court room.
Sued for the amount of the checks that were made payable to him that he couldn't cash because they bounced?
Not gonna happen in this lifetime - they can't sue him.
did the company file bankruptcy BEFORE he cashed the checks and they bounced?
No way. There is a such thing as statute of limitations. He earned the $.
