Renting & branch of tree fell, who is responsible for removal?
I understand my renters insurance will pay for personal property damage, but should my insurance have to pay for the removal of the limb?? It is large and needs to be cut up and hauled off. Isn't that the responsibiity of the property owner?
Answers:
YES
whoever is most responsible will see to it, right?
It creates a snake party, pretty fast.
the property owner should. I would pay an illegal to get right on it.
Your landlord is responsible for the removal unless you have an agreement in your lease that states you're responsible.
Yes it is.
I WOULD DEFINITELY THINK THE PROPERTY OWNER IS RESPONSIBLE
The structure itself is covered by the owner's fire policy (homeowners like policy that only covers the structure for rental property).
Most likely their insurance will only cover the damage to the home though, not the removal of the limb.
It is also highly unlikely that your renters policy will cover anything on this unless your property was damaged; as you said, renters policies are only for the property of the renter.
If there is any argument about the limb from your landlord you will need to check your lease and tennent laws in your area. In some places it is possible you could be responsible for a portion, especially if you were aware the limb was in danger of falling and said nothing.
Remember, you can always call your insurance company for advice, no payout on the policy means no increase in rates, so have no fear about giving them a call. Youre paying them for protection, most company consider that to include normal advice for insurance issues; afterall, its much less of a headache if you check with them before doing things and if you ask instead of making assumptions.
They can be a good resource for the laws if you talk to someone local, they typically know the things landlords try to do to scam tennents considering they sometimes advise them to do it.
Besides, if you end up being responsible for a portion, they will be more likely to do a small payout if its needed just to help you out if they know you did everything right by them.
Yes the property owner is responsible. It is their tree.
Yes it is. I do this kind of work all the time. I work part time for a rental company and our job is maintenance and such. We have removed limbs and other such objects frequently. The property owner should make arrangements to have the limb removed. If yo end up having to do it yourself or hiring some one, send him the bill.
