How do Americans deal with the injustice of Guantanamo Bay?

I hear quite often that the men being held are 'obviously guilty' even though they cannot be tried and proven. They are often called 'evil men who don't play by our rules' so again, no need to prove that they are guitly, just hold them indefinitely without charge or trial.

What would happen if Americans in America who were 'obviously evil and guilty' were to be held with no need to try them becuase everyone knows they did it and are evil?

How can America stand up and say that they are for justice and freedom when the whole world can see their hypocrasy?

Answers:
America classes these people as prisoners of war. The USA either signed up to the third Geneva Convention on 2 Aug 55 or ratified its inclusion for the third time. The dates on the linked page "/State Parties" can be interpreted either way and I've asked them to clarify the way that it should be read. They say the confusion should be resolved in a couple of days' time.

Meanwhile, the following are the "commandments" (if you like) of that third Convention:

The third Geneva Convention ("Relative to the Treatment of Prisoners of War") covers members of the armed forces who fall into enemy hands. They are in the power of the enemy State, not of the individuals or troops who have captured them

Prisoners of war MUST be:

- Treated humanely with respect for their persons and their honour.
- Enabled to inform their next of kin and the Central Prisoners of War Agency (ICRC, the International Red Cross) of their capture.
- Allowed to correspond regularly with relatives and to receive relief parcels.
- Allowed to keep their clothes, feeding utensils and personal effects.
- Supplied with adequate food and clothing.
- Provided with quarters not inferior to those of their captor's troops.
- Given the medical care their state of health demands.
- Paid for any work they do.
- Repatriated if certified seriously ill or wounded, (but they must not resume active military duties afterwards) .
- Quickly released and repatriated when hostilities cease.

Prisoners of war must NOT be:

-Compelled to give any information other than their name, age, rank and service number.
- Deprived of money or valuables without a receipt (and these must be returned at the time of release).
- Given individual privileges other than for reasons of health, sex, age, military rank or professional qualifications.
- Held in close confinement except for breaches of the law, although their liberty can be restricted for security reasons.
- Compelled to do military work, nor work which is dangerous, unhealthy or degrading.

Perhaps a USA respondent can advise as to whether these conditions are being maintained and upheld.

The fourth Convention deals with treatment of civilians, but views "civilians" as those who are wholly non-combatant. It therefore would not cover civilians held at Guantanamo as these are comprised of both suspected and confirmed fighters. It is time that the GC was updated to take account of the increased number of non-uniformed combatants who participate in the disputes of today.


What injustice? They are well cared for, have nice living areas. I suppose we could make believe we are Muslims and cut off their heads, but then we are a Christian nation still and do not do such barbarity.
Your question presupposes injustice. This is not in-fact the case. They are enemy combatants and are not subject to the same due process that stands in our court system.

They are fed and housed and generally treated well as compared with how Islamic radicals treat their detainees. Your supporting argument consists of opinion only. You cite no facts, so I must politely disagree with your findings.
At the end of the day America is a law in their own right. Have a look at the American Bill of Rights and you'll notice that they break almost every single one of those Amendments with Guantanamo. After all it is an American Facility. They are a law onto themselves. Everybody knows what dastardly devious deeds they're upto yet they carry on. Thank you, what injustice? we give them descent living conditions ( which is one heck of lot better than they would get if the situation was reversed! ). Time and again we have released these guys and they have gone right back to doing the same thing, trying to kill us and our allies. What the he-l are we supposed to do?, get them all suites at the Ritz-Carlton?, get a grip, this is just a non story that a lot of people have glomed onto just to try and break Americas bal-s. So I suggest you either come up with an alternate solution if it bothers you that much because I'll be waiting to hear it. As far as I'm concerned I couldn't care less, because I know they're all claiming their innocence, just like most of the people in prison, but if that's the case then why are so many rearrested for doing the same thing?.
Say what you like about whether they are actually terrorists or should be imprisoned but the simple fact is that the American Penal System is unable to cope with such high risk prisoners. These are not murderers or rapists but high-scale radical fundamentalists who will die for their cause-They pose a huge risk

when Americans talk about freedom and justice, they really mean just for Americans, how can it be justice when you go into another country and ignore international law, round up people and abduct them to another country and hold them with out trial for as long as five years.
this is all going to come back to haunt them one day mark my words.
Because no one will stand up against them. If you do, your a terrorist. They use our own fear against us and pretend to defend us against it. That's why they can treat human beings like dogs with rabies in Guantanamo bay. This persecution of Muslims is kind of similar to the Nazi genocide of the Jews.
These are human filth who should have been killed on the battle field as they are not a soldier for any government and their sole mission is to kill innocent people OR our armed forces. They aren't simply "picked up around the world" as you stated like a simpleton. These are people actively engaged in trying to kill us and destroy our way of life.

How would you address the fact that mor than a dozen of the Gitmo detainees who have been released have gone back to fighting us? And that's only the dozen we KNOW ABOUT and have caught.

Your bleeding heart for our enemy is despisable. You should be glad that those animals are locked up and not killing soldiers or YOU here.

And as far as laws are concerned, the detainees have NO RIGHTS under American law since they were not found on American soil, nor have they been kept on American soil. Guantanamo is a military jurisdiction which gives no jurisdiction to US courts. I don't like Guantanamo either, I think these rats should be killed after all useful intelligence has been extracted.
Most of the men in Guantanamo Bay were picked up by US military personnel in combat against them, not in uniform. Technically, by the laws of war, we could just put them up against the wall and shoot them. They should be thanking Allah every d*** day that instead we put them in a place where they get 3 squares a day (most detainees gain weight there), a bed (when I was in Iraq it was in 2003 for the invasion, we slept in holes in the ground), and prayer time.

The worst we have EVER done to these pricks isn't even a candle next to the sun as to what they do to our guys when they catch them. We don't behead them, beat them, run electricity through them, or anything like that.
Because who will stop the most powerful military force in the world. When you are the strongest you can do what you like and not have to give a **** about anyone else's opinion. Could you imagine the situation if Germany had wanted to attack Iraq against the UN's wishes? It wouldn't have happened and the chancellor would have been likened to Hitler
Firstly they have a British resident there that was taken off the streets in Africa.
Secondly Geo Bush declared the war over long ago.
The forces in the 2 countries illegally occupied are supposed to be there helping with the rebuilding.
