Can you tell me where John Howard recieves his authority to act?
I can't find the position of Prime Minister anywhere within Australian Federal Costitution.
Answers:
The position of PM is not in the constitution, but is the result of constitutional convention, similar to the UK.
Most of the powers of the PM actually are the attributed in the constitution to the Governer-General or the Governer-General in Council, meaning that he acts only on the advice of, and in accordance the Federal Executive Council (e.g. the command of the armed forces).
There is NONE. Australia like Britain and the Westminster system we inherited are based on conventions not the rule of law. You wont find his name anywhere in the constitution. Technically he shouldnt even be the leader, the system we have now has just evolved over time.
Australia is a representative democracy, and not a constitution, thus the Prime Minister receives authority through the eligible citizens of Australia who are all granted the right to speech and assembly (not legislative assembly).
I believe the leader of a party which wins an election goes to the Governor General who grants him permission to form a government. He is then known as the Prime Minister.
