Under this circumstance, how do you calculate the Overtime?
1. Under an alternative bi-weekly work schedule (9/80: Eight 9-hr workdays & One 8-hr work day in TWO week period). The employees have signed an agreement to honor the alternative.
2. The workweek starts on Saturday, ends on Friday.
3. Normally, an employee's 9/80 schedule should be like this:
------------Mo Tu We Th Fr Sa Su Total
Week 1: 9 9 9 9 8 0 0 44
Week 2: 9 9 9 9 0 0 0 36
Now, here's the situation, a Non-exempt employee worked 4 extra hours on Saturday at Week 1. his work schedule was like:
-----------M T W T F S S Total
Week 1: 9 9 9 9 8 4 0 48
Week 2: 9 9 9 9 0 0 0 36
How do you calculate his overtime hours?
Answers:
This should have been addressed in the agreement. Any hours over 80 in the two week period should be overtime.
I would say the first week the employee had 4 hours of overtime. It is 4 hours more than a normal schedule and that is how I came to that answer.
According to the agreement, it appears anything over 80 hours during a set two week period would be eligible for overtime. So I would say 4 hours.
If that is the case, then the overtime is 4 hours.
