Is it a good idea?

earlier i asked a question about a lawsuit scam. the answers that i received said it was not a legitimate suit. i searched online for something called "scavenger debt collectors". that is exactly what the "lawyer" who called me sounded like. i am thinking about calling them back,agreeing NOT TO PAY,and taking my chances in court where i sue them for harrassment.is this a good idea?

First, if you owe the money, it is not a good idea to go to court, you could be held liable for additional court costs and interest, plus a judgement could be entered against you and show up on your credit rating. That could affect your ability to get loans in the future. Second, if a debt collector is pursuing the debt in accordance with the Fair Debt Collection Practices Act, you do not have a claim for harassment. If they did violate the Act, your claim is for, at most, $1000.00 (and attorneys fees if you hire an attorney). Obviously, if you don't owe the money, you have a legitimate claim.

If you do owe the money, it is better to negotiate some settlement with the creditor than take your chances in court. Remember, these attorneys are in front of the same judges day in and day out, and have an advantage in court because of this. That doesn't mean not to pursue your legitimate claims, but, don't gamble on winning if you really owe the money. You have more to lose than gain.

I hate bill collectors harassing me and that is exactly what they do. I don't see why you shouldn't be able to sue them for harassment. Go for it!
If you want to be sure request that they stop phoning you and request the information regarding your outstanding debt to be posted to you.

If they have only only contacted you once it is not harassment, however if it is a legit claim then they do have a case, however they should formally serve you with all the information pertinent to the case.
