Is it legal for a parent to name his current wife on school/doctor forms instead of ex who is joint custodian?
My ex-husband & I have joint legal & physical custody of our son yet he continually leaves my name off of school and doctor forms & documents he fills out. Instead he lists his current wife as "parent" & "guardian." He never even discloses to the school and/or doctor that there is a custody agreement between us.
My school system is now telling me the burden of proof is left up to ME to provided necessary court papers to back up my claims as parent & guardian. I have provided those papers but they are now telling me that because my ex was the one to REGISTER my son at school that he solely has the right to list who he will allow to see or pick up my son at school? IS THIS LEGAL?! Again, I have court awarded JOINT LEGAL & PHYSICAL custody & we share time 50/50.
ARE THERE ANY LEGAL RAMIFICATIONS FOR MY EX'S ACTIONS OR AM I AT HIS MERCY & THE MERCY OF THE SCHOOL SYSTEM?
Attorneys or other parents who are victims of this situation.please help.
Answers:
I say either you bring copies of your custody papers to the school or have your lawyer do it.
You need a court order.
Have a lawyer send a nasty letter to the school. My guess is the school will not want to find itself in the middle of a custody battle. A nasty letter is probably all it will take.
After that, it will be up to you to make sure your name is on those forms.
