Law: Can anybody have both civil suit and criminal charge of the same case at the same time?
Example:
Somebody hit me in the face.
I report to police for criminal offence.
At the same time i hire a lawyer to sue him for "Battery" as a civil suit.
Is that possible?
Answers:
Yes, it is possible. For the most part others would wait until the outcome of the criminal case. But, we must not forget to remind ourselves that getting a criminal conviction or not, does not release one from any civil responsibility or liability.
there are many cases in that way
yes it is possible look at O.J.
Very possible.
OJ was criminally prosecuted for murder; later found not guilty.
OJ was then sued by the estates of Nicole Simpson and Ronald Goldman for the same act, and was found liable.
Absolutely, you can have it at the same time. Usually, people wait until after the criminal trial because if you were found guilty there, you will probably be held liable in civil court.
But there's nothing against doing it at the same time. You can sue anyone at anytime regardless if they are having another trial. They are technically two separate trials, which is why Double Jeopardy doesn't apply.
Sure. Make sure you get all the documentation from the police report, as well as everything about your medical bills, missed work, and other effects it had on you.
It would probably be better to wait until the criminal case is over -- mostly so you can have extra ammo against this guy, just so you can say "he was convicted in a court of law of it" and make it easier on yourself regarding your burden of proof.
It's possible, depending on the Law Of The Land
