Smoking at home when someone is working on your house?
How does the no smoking in work places policy work for people like plumbers, sparkies, and so on? Is it illegal for me to smoke in my house whilst someone is working in it?

I checked with the police. No it is not illegal to smoke in your own home. However it would always be kinder to be considerate and ask if they mind?

I have a relative (council tenant) who is having some work done by the council. They have been told that they will not be able to smoke in the presence of the council worker.

You can smoke at home all the while they are working PROVIDED you do not assist them - otherwise it becomes your workplace too.
They on the otherhand cannot at all - as it is their workplace.
I think it is legal, but the person working on your house can refuse to work there if they think it is too smokey. Not 100% sure though!
You can smoke in your house whilst people are working. The ban was only applied to public places and places of work. That means that you can't smoke in an office or building. Your house is a private place!
Give the nanny pols a month or two, I am sure that restriction is coming soon.
It is not illegal. After all, you are the owner. As long as you think endangering your own life is no others' business, go ahead. But you would have to make sure the workers don't breathe in the 2nd hand smoke and sue you later for their smoke-related sicknesses.

Let's say you hired a domestic worker (maid, char-lady, you know what I mean).
could s/he then sue you for unfair or constructive dismissal if you lit a cig?

My friend works as a stairlift eng. he walks out if the house is full of smoke, they knew he was coming to help them,

Hello wake up it is YOUR house and you can tap dance if you choose while someone is working there. As for any one coming into your home and smoking again it is your home your choice.
If you own your home you may smoke no matter who is in the house, but if your property is rented, and the landlord has sent someone in to the house to do repairs, you will not be able to smoke while the workman is in the house, that is the law in the UK.
Ofcourse you can smoke, its your own private property.
Our local council has asked tenants not to smoke for the half hour before their men enter the premises. Does that mean that if I am told they Willl be there at 10 they wil be punctual? I do hope so as in the past I have wasted hours waiting for them to arrive.
I don't think it is The trades man may refuse to work on the property because of you smoking and i think that would be his/hers right . If it is your gaff and you want a ciggy then you have one and to hell with all the rest .
