Advertsing law?
my friend had her sons photo taken professionally and the person who took them never got back to her when he said her would.
she forgot about it and a few months later found a leaflet with her son on that the photographer had used for advertising and i just found it on his site on the internet!
is he allowed to do this without her permission?

simply put NO but are you sure this as happened is it because a similar case recently in the news, it seems funny two cases in such a short time.

No, if he wanted to use it for advertising he should have got her son to sign a model release form which allows for the photographer to use the photo

No I don't think he is, unless she signed a disclosure. he is being a bit cheeky really, I would look into it, she may be able to claim some money from him.
No he is not that is completly illegal, go to a solicitor. however if ur friend filled in forms she may have (not understangly) signed to accept this. either way he should of contacted to state his intentions.
Absolutely NOT! Every time I arrange a photo shoot with a model-- the model MUST sign a release form before I can use his/her image for anything. If not-- I can be sued and would certainly lose.

you must get a model consent form signed, or you can sue.
you can go to court and get an injunction on him using the image, and claim costs etc..
the least they guy could do is offer a free sitting and apologise, or you can claim compensation, go see a solicitor and seek their advice
This is breach of your privacy and the exploitation of a minor. Report the photographer to the police.
