In family law if a mom has no credibility does there need to be a trial?
Answers:
Credibility is a triable issue. In our system of justice, the jury or judge are to weigh the credibility of witnesses and determine the outcome of a trial. This is the case in family law more than other areas of law.
If she truly has zero credibility, a motion for summary judgment may work but generally credibility issues are left to the trier of fact.
Credibility has nothing to do with it, and besides credibility can't be established except by trial. I'm not sure what the issue is, but if there needs to be a trial then there will be a trial. Lack of credibility is no excuse.
