Can a homeowner sue his/her HOA?

If the HOA is obligated to do something - fix or maintain the property or treat the members equally - and they don't do it, the member (owner, not a renter) can sue the HOA to force them to do what they are required to do. In some states the prevailing party (which can be you OR the HOA) is entitled to fees so make sure you are right about it before you file, and if you want to live there when you are done (after all your neighbors get assessed to pay for attorneys fees the HOA spends defending your suit) don't file it for something stupid. Try to show up at a HOA meeting to talk to the board and threaten to sue or send them a letter (or one from your atty) setting forth your demands. Will probably get more done that way more quickly and then not have all your neighbors hate you.
sure but check the by laws, you may be required to post a bond to sue, and depending on what you want to sue about you may not even have standing need more info
