What can I do about being evicted.?
Being evicted from mobile home park in state of Maine. They gave me a 7 day notice to quit. I didn't and now I have to go to court next week. According to Mobile home park rules in the consumers law guide I thought they had to give me 30 days for non payment of rent.
Answers:
See if the judge agrees with your 30 day rule. More importantly, spend your time finding a place to live (and pay on time).
If your landlord will take the rent payment, give it him/her and make sure to get a receipt. If not, make several attempts to pay the rent and if possible, get witness statements attesting to your attempts to pay.
Go to court next week with your statements and plead your case with the judge. But, be prepared for the possibility that you will be evicted.
Good luck.
I'm not familiar with the laws in the State of Maine. I can tell you how a situation like this would happen in Michigan
I would think you have the right to hold your rent into an escrow account until the repairs are made. Make sure you take documentation into court that says you have an escrow account. Just explain to the judge what happen and why you are refusing to pay rent.
The landlord has the choice to seek a 7day quick release or a 30 day notice (it's really up to the landlord).
Hope this helps. Good Luck
