In the meantime I have been offered another job and so resigned from my present position (that im on suspension from) Up until yesturday i ahd been told that i must return my company vehicle but today i resigned ..they are still asking for the car back yet i have 4 weeks notice period. have my rights now changed ?
Answers:
If YOU left, you owe them the car back. So give it back now and save yourself a court date (on the car) and a law suit.
yes- you can't keep it. and you will still have to go to the fraud hearing so it can be investigated
hopefully you have notified your new employer or won't be there for long. If you aren't still there I'm sure they have the right to get the car back.
Hi, sorry its bad news, the day you leave employment, as part of your contract, you have to hand back all company owned assets, IT, keys, id, passes, cars etc, the four weeks notice will only reflect for your salary and the time you have to give each other to go your own ways, even if your on gardening leave (left now, company advise if you go now we will pay until..) they will expect the car back, but watch out, if they wanted to be funny, they can report it to the police, assuming your driving on company insurance, as you dont work for them anymore you wont be covered, and report the car as been unlawfully kept by you, or worse, report it to revenue and customs for tax, if you use it as a pool car, as your not using it for business use and therefore could be fully taxed for the fiscal year!.
whilst is often good to have one back over the old firm, on this one its not worth the grief.
good luck on your new job!
Just return the car. If you're being investigated for fraud, you need to earn a few brownie points.
if you leave you give up all your privilidges as worker of that company,
GIVE the car back
