Does giving incorrect personal informations while chatting on net amount punishable offence?see detail India.?
While chatting on internet if someone gives incorrect information regarding age/ location / gender/ marital status/ adress/ phone no. and tells lie regarding personal life... ..to avoid misuse of personal informations.
Does such act constitute an punishable offence in India?
Answers:
99.99% of people give wrong information about personal details on the net.
As long as you do not commit a fraud by this misrepresentation, there is no punishable offense.
Frauds could be for e.g.
1) getting another person to beleive you are unmarried and then under this pretest get them hooked into a physical relationship.
2) giving someone else's mobile number which would lead to harrassment of that person.
3) cheating somebody of some money with the misrepresentation etc.
In short, committing a fraud will lead to problem. harmless chat by spicing up the facts is not an offense.
Be careful of some chatters who try to act as Police to browbeat people - in fact they are committing fraud and liable for punishment.
you bet, punishable by death!
Furnishing false information will be a punishable offence only if:
(a) there is a statutory or compulsion to do so OR
(b) statement made before a public authority
(c) stated on oath
(d) with an intention to derive pecuniary advantage or causing pecuniary disadvantage to another person, acting bon-fide on such information believing it to be true
(e)with an intention of mischief by inducing the other person to do or not to do an act, which the other person, in he absence of such information, would have been dealt with contrarily.
You can yourself now evaluate.
what the hell thats one stupid question no offense. i mean u r just chatting not planning a homiside or something. i do that crap all the time! why the hell would u even tell personal info anyway i mean someone could stalk u or something. why r u wondering that? are u gonna stalk someone or something? that... u'll get a punishment for! xD
If the incorrect information results in loss of property ,dignity or sexual abuse etc,it can be challenged in acourt. To prove it may be difficult because the participant may be a fallguy.
Any way such fellows find their place in hell fire.
Probably not!! As long as the person didn't cause fraud in regards that you gave that person money, access to your credit cards etc. Unfortunately, your issue is NOT unique. It happens quite frequently and, your only recourse is to no longer be contact with this person. You should be thankful that you never meet face-to-face or did you?? Does this person know confidential information about you that can be misused and creates problems against you?? Only you can answer this. I hope that this has helped some and try to avoid chatting on the Internet because there are alot of wackos out there.
I hope you do not have any intention of cheating or taking advantage of the false information to lure the other person? If it does not harm anybody then there will not be any question of being punished.
Its not fraud until he offers her something, or meets with her with malicious intent. But rest assured she is probably a police officer pretending to be a girl to catch him, anyways.especially if you are saying she is 25 but are really talking about trying to have sex with a girl who is 12.
i donno. yaar kuch log toh jhoot hi kahte hai. agar wo job nahi karta ,fir bhi wo kahega ki am a sftwer engr. just saying kuch log aisa karte hain
It is only for safeguarding your interest sometimes you give incorrect informations to forums like this. So far as it does not infringe into rights of any individual legally, or do any harm punishable under the prevailing law of our country, it is not construed as a crime , However mind your language while chatting to see it does not cross the decency level. It is not then punishable anyway.
